Title VII prohibits “discrimination because of … sex.” The definition of “sex” has been hotly debated since the statute was enacted, with issues of sex stereotyping and sexual harassment dominating the discussion. In June 2020, the U.S. Supreme Court in Bostock v. Clayton County, Ga held that terminating an employee because of sexual orientation or gender identity was also “discrimination because of … sex,” significantly expanding the scope of the law. Congress is looking to further amend Title VII’s provisions on sex discrimination. Our presentation will cover how the Supreme Court’s decision in Bostock and the proposed statutory modifications will affect businesses.
